Clarification Text on the Protection and Processing of Personal Data

As FLC MAKİNA, we attach great importance to the processing and protection of the personal data of our customers, our esteemed users visiting our website, and our business partners, in accordance with the relevant legislation, primarily the Constitution of the Republic of Turkey and the Personal Data Protection Law No. 6698 (“KVKK”). This Clarification Text has been prepared in order to inform you transparently about the methods of collecting your personal data, the purposes of processing, legal grounds, and your rights.

1. Identity of the Data Controller

In accordance with the KVKK No. 6698, the data controller you will be addressing is the legal entity of FLC MAKİNA. Our company will process your personal data within the scope of the purposes and limits described below, in compliance with the law and the rules of honesty.

2. Purposes of Processing Personal Data

Your collected personal data (identity, contact, customer transaction, transaction security data, etc.) is processed within the scope of the personal data processing conditions specified in Articles 5 and 6 of the KVKK, for the purposes of performing the necessary work by our business units and executing the relevant business processes to enable you to benefit from the products and services offered by our Company.

Service and Sales Processes

Execution of goods and services sales processes, management of contract processes, tracking of financial and accounting affairs, and provision of after-sales support services.

Customer Relations and Communication

Planning of customer relationship management processes, receiving and resolving requests, questions, and complaints, and executing corporate communication activities.

Marketing and Promotional Activities (Subject to Explicit Consent)

Customization and recommendation of our products and services according to your usage habits and needs, and execution of campaign, promotional, and newsletter processes.

Legal Obligations and Information Security

Providing information to authorized public institutions and organizations within the scope of legal obligations, executing activities in compliance with legislation, and ensuring website transaction security.

3. To Whom and for What Purpose the Processed Personal Data May Be Transferred

Your collected personal data may be transferred within the framework of the personal data transfer conditions specified in Articles 8 and 9 of the KVKK, for the purpose of achieving the objectives mentioned above.

Domestic Data Transfer

It may be transferred to our business partners and suppliers (cargo, logistics, call center, etc.) with whom we cooperate to carry out our activities, to banks and financial advisors for financial processes, to lawyers for legal processes, and to legally authorized public institutions.

International Data Transfer

In cases where the servers of software used for communication and infrastructure services (such as email servers, cloud storage, CRM systems) are located abroad, your data may be transferred abroad within the framework of the legal conditions stipulated by the KVKK or based on your explicit consent.

4. Method and Legal Ground of Personal Data Collection

Your personal data is collected through completely or partially automated, or non-automated means via our website (contact forms, membership forms, cookies), email, telephone, physical documents, face-to-face meetings, and our social media accounts.

Your data is processed based on the following legal grounds pursuant to Article 5 of the KVKK:

Explicitly Stipulated in Laws and Legal Obligation

Fulfillment of our legal obligations within the scope of legislations such as the Tax Procedure Law and the Turkish Commercial Code.

Establishment or Performance of a Contract

Provided that it is directly related to the establishment or performance of a contract, the necessity of processing personal data belonging to the parties to the contract.

Legitimate Interest and Establishment of a Right

The necessity of processing data for the legitimate interests of our company, provided that it does not harm the fundamental rights and freedoms of the data subject, and the necessity of processing data for the establishment, exercise, or protection of a right.

5. Rights of the Personal Data Subject (Article 11 of the KVKK)

Pursuant to Article 11 of the KVKK, as data subjects, you have the following rights:

  • To learn whether personal data is processed or not,
  • If personal data has been processed, to request information regarding this,
  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  • To know the third parties to whom personal data is transferred domestically or abroad,
  • To request the correction of personal data if it has been processed incompletely or inaccurately,
  • To request the deletion or destruction of personal data in the event that the reasons requiring its processing cease to exist, even though it has been processed in accordance with the KVKK and other relevant legal provisions,
  • To request that correction, deletion, and destruction operations be notified to the third parties to whom personal data has been transferred,
  • To object to the occurrence of a result against the person themselves by means of analyzing the processed data exclusively through automated systems,
  • To request the compensation of damages in the event of suffering damage due to the unlawful processing of personal data.

6. Exercise of Rights and Contact Information

KVKK’nın 11. You may submit your requests within the scope of Article 11 of the KVKK to us in writing, pursuant to the “Communiqué on the Procedures and Principles of Application to the Data Controller”, or by using a registered electronic mail (KEP) address, secure electronic signature, mobile signature, or your electronic mail address previously notified to our company and registered in our system.

Our company will conclude the request free of charge as soon as possible and within thirty days at the latest, depending on the nature of your request. However, if the process requires an additional cost, the fee specified in the tariff determined by the Personal Data Protection Board may be requested.
